We would all like to think that we will meet someone special, fall in love, get married and live happily ever after. Unfortunately, many of may not get to that last step. In the United States, as many as 50% of marriages end in divorce, including 41% of first marriages. Given these statistics, it is important for people to have a idea about how divorce works.

In most divorces, the most important issues for parties concern children. In California, judges will typically support joint custody arrangements. A joint custody agreement is a court order whereby the custody of any children to a marriage is split between both parents equally. The scheduling of children’s stays is subject to a separate agreement called a custody schedule.

After children, property and assets are often the second most contentious issue. In the state of California is a community property state. Under this regime, all property and assets acquired during the marriage, with the exception of gifts and inheritances, are considered community property and are thus divided equally during divorce. Property acquired before a marriage is not generally considered community property.
